The tax office does not see it that way. The same metal held in forms attracts different holding periods, different tax rates and different reporting requirements. An investor who bought gold and an investor who bought a Gold ETF on the same day can face different tax outcomes when they sell on the same day.

The difference comes down to one word: listed. Listed assets get a holding period for long-term treatment. Unlisted assets wait longer. Gold ETFs are listed. Gold mutual funds are not. Physical gold and digital gold are not. That distinction shapes everything

physical gold and digital gold

Physical gold whether jewellery, coins or bars is treated as a capital asset. Jewellery is specifically excluded from the definition of ” effects,” which means the tax exemption that applies to clothes or furniture does not apply to gold ornaments.

Digital gold, sold through platforms like PhonePe or Google Pay follows the tax rules as physical gold. Buying gold attracts 3% GST. Selling it triggers capital gains tax.

The holding period is 24 months. Sell after that. The gain is long-term, taxed at 12.5% without indexation. Sell before. The gain is added to income and taxed at the applicable slab rate, which can reach 30% or more.

There is one exemption knowing. Long-term capital gains from gold can be claimed under Section 54F if the proceeds are reinvested in a house. The conditions are specific. The provision exists.

gold ETFs

Gold ETFs trade on stock exchanges which gives them a holding period. Units held for than 12 months qualify for long-term capital gains tax at 12.5%. Units sold within 12 months are taxed at the slab rate.

The difference between 12 months and 24 months is not cosmetic. An investor who needs to sell after 18 months can do so with a Gold ETF. Pay 12.5% on the gain. The same investor holding a gold fund or physical gold would pay slab rates, potentially 30% or higher.

gold mutual funds

Gold mutual funds invest in Gold ETFs. They are structured as unlisted fund-of-funds. Because the units are not listed on an exchange the holding period reverts to 24 months.

This is a feature, not a choice by the fund house. The fund itself is unlisted so the units are unlisted,. The tax treatment follows the unlisted asset rules.

For an investor comparing a Gold ETF and a gold mutual fund the ETF offers a path to the lower tax rate. The mutual fund offers convenience since units can be bought through a mutual fund folio without a demat account. The trade-off is the holding period.

sovereign gold bonds

Sovereign Gold Bonds sit in a category of their own. They are government securities issued by the RBI. They carry a 2.5% annual interest on the issue price.

The interest is taxable at the slab rate. That has always been the case. Has not changed.

The capital gains treatment is where the rules have shifted. For bonds subscribed directly in the RBI issue and held until the eight-year maturity redemption is exempt from capital gains tax. Bonds purchased later through the market do not qualify for this exemption on redemption.

The practical implication is that the tax-free benefit applies to the original subscriber. An investor who buys SGBs on the exchange is buying an asset even though the original holder sold it as a tax-free one.

the gst on purchase

Capital gains tax is one part of the cost. Buying digital gold attracts 3% GST on the value of the metal. For jewellery making charges attract a 5% GST.

The GST is paid upfront. Cannot be adjusted against the capital gains tax when the gold is sold. It increases the acquisition cost, which in turn reduces the gain but it is a separate outflow.

what retail investors should take from this

The tax treatment of gold is not uniform. The holding period and the rate depend on the form the gold is held in. Gold ETFs get long-term treatment after 12 months. Physical gold, gold and gold mutual funds require 24 months.

Sovereign Gold Bonds offer the favourable treatment for original subscribers who hold to maturity. The capital gain is exempt though the interest is taxable. For anyone buying SGBs on the market that exemption does not apply.

For an investor choosing between forms the decision should weigh the tax treatment against the convenience and liquidity of each option. A Gold ETF held in a demat account offers the path to the lower tax rate. Physical gold offers tangibility. A longer wait for the same treatment. Digital gold offers ease of purchase but the same 24-month holding period as physical.

FAQs

1. How long do I need to hold gold for long-term capital gains tax?

It depends on the form. Gold ETFs qualify after 12 months. Physical gold, gold and gold mutual funds require 24 months.

2. What is the tax rate on long-term capital gains from gold?

Long-term gains from all forms of gold are taxed at 12.5% without indexation. This rate applies to transfers on or after 23 July 2024.

3. Are gold funds taxed differently from gold ETFs?

Yes. Gold ETFs are listed,. The long-term holding period is 12 months. Gold mutual funds are unlisted fund-of-funds. The holding period is 24 months.

4. Is Sovereign Gold Bond redemption tax-

For bonds subscribed in the RBI issue and held until the eight-year maturity redemption is exempt from capital gains tax. Bonds purchased on the market do not qualify for this exemption.

5. Is GST paid on gold purchases against capital gains tax?

No. The 3% GST, on digital gold purchases increases the acquisition cost but cannot be adjusted against the capital gains tax liability when the gold is sold.

Gold is gold.
