The first route is to buy US‑listed ETFs through the Liberalised Remittance Scheme (LRS). This route offers a tax treatment for long‑term holdings. The second route is to use India‑domiciled mutual funds or ETFs. These instruments are easier to manage but carry a tax burden. The right choice depends on how operational complexity Indian investors are willing to handle in order to achieve a lower tax rate.

The direct route: US‑listed ETFs

The efficient method to follow an index such as the S&P 500 is to purchase a US‑listed ETF like VOO (Vanguard S&P 500 ETF) or IVV (iShares Core S&P 500 ETF). For the Nasdaq 100 the standard choice is QQQ (Invesco QQQ Trust).

How it works.

Indian investors open a brokerage account via a GIFT City platform or a global investing application. They remit funds under the LRS. Purchase the ETF in dollars. The annual LRS limit is $250,000 per individual. If remittances exceed ₹10 lakh in a year a 20% TCS is applied to the excess. This TCS can be adjusted against the tax liability of Indian investors.

The tax advantage.

Indian investors treat US‑listed ETFs as foreign securities under Indian tax law. If Indian investors hold them for over 24 months the long‑term capital gains tax is 12.5%. Indexation is not applied. If Indian investors sell before 24 months the gain is added to investors income and taxed at Indian investors slab rate, which can reach 30% or higher.

The costs.

Indian investors pay a spread of about 0.5% to 1.5% on the remittance plus any brokerage fee charged by the platform. The ETF itself has an expense ratio; VOO charges 0.03% and QQQ charges 0.18%.

The compliance.

Indian investors must disclose holdings in Schedule FA of the income tax return. If the ETF pays dividends the United States withholds 25%. Indian investors must file Form 67 to claim a foreign tax credit in India.

The indirect route: India‑domiciled funds

If the LRS paperwork and Schedule FA disclosure seem complicated Indian investors can buy India‑domiciled mutual funds or ETFs that invest in US indices. Examples are Motilal Oswal Nasdaq 100 FoF and Mirae Asset Nasdaq 100 ETF.

How it works.

Indian investors invest in rupees through an existing mutual fund platform. There is no LRS remittance no foreign brokerage account and no Schedule FA disclosure.

The tax disadvantage.

This is the difference. India‑domiciled international funds are treated as non‑equity funds for tax purposes because they hold less than 65% in domestic Indian equity. Consequently all gains are taxed at investors income tax slab rate no matter how long Indian investors hold the fund. An Indian investor in the 30% bracket pays 30% on the gain whether the sale occurs after one year or after ten years.

The availability issue.

SEBI has at times restricted inflows into international mutual funds when the industry‑wide overseas investment limit is reached. Some funds have suspended lump‑sum investments or SIPs for periods because of this.

Comparing the two routes

Feature

Direct US‑listed ETF (VOO/QQQ)

India‑domiciled international fund

Holding period for LTCG

24 months

Not applicable (always slab rate)

Tax on long‑term gains

12.5% (plus cess)

Slab rate (up to 30%+)

Tax on short‑term gains

Slab rate

Slab rate

LRS required

Yes ($250,000 annual limit)

No

Schedule FA disclosure

Yes

No

TCS above ₹10 lakh

20% (adjustable)

No

Availability

Consistent Subject to SEBI limits

Subject to SEBI limits

Operational complexity

Higher

Lower

which route fits which investor

The direct route suits an investor who plans to hold for more than two years is comfortable with the LRS remittance process and desires the lower 12.5% long‑term tax rate. The operational friction is front‑loaded; after the account is funded and the ETF is bought Indian investors face ongoing management.

The indirect route suits an investor who is investing small amounts wants to avoid foreign asset reporting or is willing to accept the higher slab‑rate tax for simplicity. It is also the option, for Indian investors who want to invest through a regular SIP without initiating a bank remittance each month.

If you hold an investment for a time and you are in the 30 % tax bracket the tax difference becomes very important. Put ₹10 lakh into a fund that grows to ₹30 lakh over ten years. Under the route the ₹20 lakh gain is taxed at 12.5 %, which equals ₹2.5 lakh in tax. Under the route the same ₹20 lakh gain is taxed at 30 %, which equals ₹6 lakh in tax. The ₹3.5 lakh difference is bigger than any expense ratio or forex cost.

what retail investors should take from this

The direct route is tax‑efficient for long‑term holdings but it requires navigating LRS, TCS and Schedule FA. The indirect route is simpler. Taxes gains at your slab rate no matter how long the holding is.

If you choose the route start with a broad index ETF such as VOO for S&P 500 exposure or QQQ for Nasdaq 100. Both are highly liquid. Have low expense ratios. Confirm that the platform supports investing if you want to start with a small amount because a single share of VOO may cost several hundred dollars.

If you choose the route check whether the fund is currently accepting fresh investments. SEBIs overseas limits have caused periodic suspensions and a fund that was open month may be closed today.

FAQs

1. What is the LRS limit for investing in US ETFs?

The RBIs Liberalised Remittance Scheme allows resident individuals to remit up to $250,000 per year for permitted overseas investments, including US ETFs.

2. How’re US‑listed ETFs taxed in India?

US‑listed ETFs are treated as foreign assets. If you hold them for than 24 months gains are taxed at 12.5 % without indexation. If you hold them for 24 months or less gains are added to income. Taxed at the slab rate. The ₹1.25 lakh LTCG exemption does not apply to ETFs.

3. Why are India‑domiciled funds taxed at slab rates?

Because they hold than 65 % in domestic Indian equity they are classified as non‑equity funds for tax purposes. All gains are taxed at the investors slab rate no matter how long the holding is.

4. What is TCS. How does it affect US ETF investing?

Tax Collected at Source applies once total LRS remittances cross ₹10 lakh in a year. The rate is 20 %, on the excess. It can be adjusted against your tax liability but it blocks cash until your return is processed.

5. Do I need to report US ETF holdings in my ITR?

Yes. Resident and Ordinarily Resident taxpayers must disclose all assets in Schedule FA of the ITR including US ETF holdings even in years when no shares were sold and no dividends were received.

Indian investors have two routes to obtain exposure to US market indices such as the S&P 500 or the Nasdaq 100.
